Terms of Service

These Terms of Service ("Terms") are a contract between you and Decademy for use of https://decademy.app and related features (the "Service"). By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to them and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a school, chapter, or other organization, you represent that you have authority to bind that organization and to invite students or upload their work.

Decademy is an independent study platform. We are not affiliated with, endorsed by, or sponsored by DECA Inc. or any DECA chartered association. DECA names, event codes, and related marks belong to their owners and are used only to describe the competitions students are preparing for.

Practice questions, flashcards, roleplay scenarios, rubrics, and explanations on the Service are original or independently created for educational practice. They are unofficial. We do not reproduce official DECA exams or copyrighted DECA testing materials. Using Decademy does not guarantee any competition result, qualification, or score.

You must be at least 13 years old (16 in the European Union, unless valid consent is obtained where required) to create an account. The Service is intended for high school students, alumni helpers, teachers, and DECA advisors.

You may sign in with Google or with an email address and password. You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for activity on your account. Notify us through the Contact form if you believe your account was used without permission.

We may refuse, suspend, or close an account if we reasonably believe these Terms were violated, the account is unsafe, or we are required to do so by law.

Decademy may include, without limitation:

• Cluster exams and other multiple-choice practice, explanations, and progress tracking.
• Flashcards and related study tools.
• AI-generated roleplay scenarios, optional microphone or camera recording, transcription, and rubric-style feedback.
• Written-event helpers and file or text uploads.
• Classrooms: join codes, invite links, rosters, assignments, calendars, analytics, and teacher review of student work.
• Dashboards, streaks, goals, bookmarks, profiles, and an optional public leaderboard.
• Contact and support forms.

Features may change, break, or be withdrawn. We do not promise uninterrupted availability. Practice history stored only on your device (for example, an unfinished test in local storage) can be lost if you clear the browser.

Roleplay generation, transcription, scoring, explanations, and similar features use automated systems, including third-party models. Outputs can be incomplete, inconsistent, or wrong. AI scores are practice feedback only. They are not official DECA judging, they are not a substitute for a teacher or advisor, and they should not be treated as a guaranteed prediction of competition performance.

You remain responsible for how you use AI output. Do not rely on the Service for legal, medical, financial, or other professional advice. Do not submit content you are not allowed to share.

Teachers and advisors who create classrooms control join settings, invites, assignments, and member roles. Students who join can see classroom content and may have their name, submissions, and scores visible to classroom admins and, depending on settings, other members.

• Only invite people who should have access. Treat join codes and invite links like passwords.
• Do not upload official student records, government IDs, or other sensitive data the classroom does not need.
• If you are an educator, you are responsible for obtaining any parental, student, or school permission required before students use the classroom.
• We may remove classroom content or memberships that violate these Terms or create a safety or legal risk.

You may submit text, files, audio, video, names, comments, and other material ("User Content"). You retain ownership of your User Content. You grant Decademy a worldwide, non-exclusive, royalty-free license to host, store, process, transcribe, display, and transmit that content solely to operate, secure, and improve the Service (including sending it to subprocessors such as transcription and AI providers).

You represent that you have the rights needed to submit User Content, that it does not infringe others' rights, and that recorded voice or video only includes people who agreed to be recorded. If you record a partner or judge-style practice with another person, get their permission first.

You agree not to:

• Use the Service for anything illegal, harassing, hateful, or sexually exploitative, including any sexual content involving minors.
• Attempt to access another person's account, classroom, or data without authorization.
• Probe, scan, or reverse-engineer the Service in a way that disrupts others, or bypass rate limits, paywalls, or security controls.
• Upload malware, scrape the Service at a volume that harms availability, or use automated bots except ordinary search-engine indexing.
• Copy, redistribute, or sell our question banks, roleplay scenarios, or other non-user content except for your own personal study or a classroom you teach.
• Present Decademy materials as official DECA exams or as your original competition entry when rules forbid outside assistance.
• Use AI features to generate abusive content or to attempt to obtain official secured exam items.

The Service, including software, original questions, explanations, design, logos, and documentation, is owned by Decademy or its licensors and is protected by copyright and other laws. We grant you a limited, revocable, non-transferable license to use the Service for personal or classroom educational purposes while these Terms remain in effect.

Feedback you send us (ideas, bug reports, suggestions) may be used without obligation to you.

If you believe content on the Service infringes your copyright, send a notice through our Contact form with: (a) your contact information, (b) a description of the work and where it appears on the site, (c) a statement that you have a good-faith belief the use is not authorized, (d) a statement under penalty of perjury that the notice is accurate and that you are the owner or authorized agent, and (e) your physical or electronic signature. We may remove material and, in appropriate cases, terminate repeat infringers.

The Service depends on third parties, including hosting, authentication, analytics, email delivery, and AI providers. Their terms apply to their services. An outage or change at a provider can affect sign-in, classrooms, or AI features. School networks that block Google, third-party scripts, or media permissions may limit parts of the Service; email sign-in is offered as an alternative where Google is blocked.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECADEMY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that questions are error-free, that AI feedback is accurate, or that the Service will meet your competition goals.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECADEMY AND ITS TEAM MEMBERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR COMPETITION OUTCOMES, ARISING FROM THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF TEN U.S. DOLLARS (US $10) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. If the law in your jurisdiction does not allow some of these limits, they apply only to the extent permitted. Nothing in these Terms limits liability that cannot be limited, such as liability for fraud or for death or personal injury caused by negligence where such a limit is prohibited.

You will defend and indemnify Decademy and its team against claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your classrooms, your misuse of the Service, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

You may stop using the Service at any time. You may request account deletion through the Contact form. We may suspend or terminate access immediately if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive (including intellectual property, disclaimers, limits on liability, and indemnity) will survive termination.

We may update these Terms as the Service evolves. The effective date will change when we post an update. Material changes will be noted on the site when practical. If you continue to use the Service after updated Terms are posted, you accept the new Terms.

These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict of law rules, except that if you are a consumer living elsewhere, mandatory consumer-protection laws of your place of residence still apply. Courts located in Florida will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect the Service or intellectual property, and except where applicable law requires that you may bring claims in your home courts.

These Terms are the entire agreement between you and Decademy about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Service. Headings are for convenience only.
